This Privacy Policy describes how Cohost Tech, Inc. ("we," "us," and "our") collects, uses, and shares personal information when you use our mobile application, Moodsearch (the "App"), and our website at https://moodsearch.com (the "Site"). Some information you provide through the App or the Site may be considered consumer health data under applicable laws. For more information, see our Consumer Health Data Privacy Policy.

We collect personal information from you, from Apple when you sign in, and automatically through your use of the App and Site, including:

• Account information: Sign in with Apple identifier, name you enter (first and/or last), and email address.
• Profile and onboarding information: Birthday you provide during onboarding.
• Check-in content: The mood-related information you enter in the App, including mood selections, the patterns you track and your scores, free-text notes, and onboarding responses, along with the possible patterns we suggest during onboarding, which you choose to track.
• Usage and analytics data: Information about how you use the App and Site, including interactions, events, pages viewed, and device and crash/error information. On our Site, this may include recordings of your session.
• IP address: Collected when you use the App or interact with the Site, for security, analytics, and compliance purposes.
• Waitlist email: The email address you provide to join our waitlist or subscribe to updates on the Site.
• Subscription status: If you purchase a subscription, Apple processes your payment. We receive your subscription status through our subscription management provider.

We use personal information to provide, operate, maintain, and improve the App and Site; to personalize your experience; to send push notifications; to process subscriptions; to protect security; and to comply with law. We use your email address to send you newsletters, product updates, and other communications about Moodsearch. Every marketing email includes an unsubscribe link, and you can opt out at any time.

Service Providers

We share personal information with service providers that process data on our behalf, including: AI service providers; analytics provider; email service provider; push notification provider; hosting and infrastructure provider; error monitoring provider; authentication provider; subscription management provider; and app update provider.

Third Parties

We share certain personal information with the following third parties, who may use it for their own purposes:

• Advertising and marketing analytics providers: We share your account identifier, app activity events, and certain device information, such as device model and operating system version, with advertising and marketing analytics providers.

Law Enforcement and Legal Process

We may disclose personal information if required to do so by law or in response to valid requests by public authorities, including to comply with a court order, subpoena, or other legal process, or to cooperate with law enforcement.

Business Transfers

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your personal information may be transferred as part of that transaction.

Depending on where you live, you may have the right to access, correct, delete, obtain a portable copy of your personal information, or opt out of the sharing of your information for targeted advertising.

To submit a request, email privacy@moodsearch.com or delete your account in the App via "Settings, Delete Account." We will not require you to create a new account. We respond to verified requests within 45 days and may extend once where permitted by applicable law; if we extend, we will notify you within the initial 45-day period with the reason. If we deny your request, you may appeal by emailing us; we will review and respond within 45 days.

If you joined our waitlist, you can ask us to review or update your email address, or to stop receiving our emails, by emailing privacy@moodsearch.com or using the unsubscribe link in any email we send. Other information collected automatically through the Site is not linked to an account, and we are unable to associate it with you to fulfill an access, correction, deletion, or portability request.

We will not discriminate against you for exercising any of these rights.

We retain your personal information for as long as your account is active. When you delete your account, your personal information is deleted from our active systems. Consent records, a record of your deletion request, and operational service usage records are retained after account deletion for compliance and audit purposes. Deletion from backup systems may take up to 35 days.

Deleting your account does not cancel any active App Store subscription. To stop subscription billing, manage your subscription in the App Store.

We implement reasonable technical and organizational measures to protect your personal information, including encryption of data in transit and at rest.

We do not respond to web browser "Do Not Track" signals.

Our Site uses first-party cookies and similar browser storage set by our analytics provider to operate analytics.

We are committed to protecting the privacy of children. The App is intended for users 18 and older, and we do not knowingly collect personal information from anyone we know to be under 18 through the App. The Site is not designed or intended to attract anyone under 18, and we do not knowingly collect personal information from any person we actually know is under 18 through the Site. If you believe we have collected information from someone under the applicable age, contact us at privacy@moodsearch.com.

The App and Site are intended for users in the United States. We make no claim that they are appropriate or available for use outside the United States. If you access them from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. Your information will be processed in the United States.

We use AI in the App and on our Site to suggest possible patterns; to power an interactive check-in and draft check-in notes in the App; and to create summaries and personalized notes shown to you in the App. This content is generated by AI, not a human. We do not collect, use, or sell personal information for the purpose of training large language models.

The App and Site do not diagnose or treat any condition and are not a substitute for professional support.
